GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale aim to define the terms and conditions for the sale of products offered by LILILOTTE SARL on its website www.lililotte.com.

The website is intended for consumers, who are natural persons of legal age or non-trading legal entities. The consumer declares having the legal capacity to enter into a contract.

Non-resident internet users in France wishing to place an order via the website must verify if the law applicable to them authorizes this type of transaction.

The existence of the website does not constitute canvassing, and the contract concluded between the consumer and LILILOTTE is a distance contract.

The purchase of products offered on the website for resale is strictly prohibited.
Any order placed on the website assumes that the consumer has consulted and agreed to these general terms and conditions, as evidenced by checking the box:
"I have read the general terms and conditions of sale and I accept them without reservation."


Article 1 – WEBSITE PUBLISHER

LILILOTTE is a Limited Liability Company with a capital of 1,000 euros, whose registered office is located at 207 boulevard Auguste Peneau – 44300 Nantes, registered in the Nantes Trade and Companies Register under number 983 138 983.

Article 2 – PURPOSE

This contract determines the rights and obligations of LILILOTTE and the consumer in the context of the sale of products offered on the website www.lililotte.com.

These general terms and conditions of sale express the entirety of the rights and obligations of the parties.
Any contrary condition not accepted in writing by LILILOTTE will be unenforceable.
Documents such as catalogs, visuals, or advertisements are for informational purposes only and are not contractual.


Article 3 – PRODUCT CHARACTERISTICS

LILILOTTE presents the consumer with the essential characteristics of each item via a detailed description and illustrative photographs.

The consumer is invited to read this information carefully before placing any order.
These characteristics relate in particular to size, color, composition, materials, and finishes.
Color variations may exist depending on screen resolution, without engaging the liability of LILILOTTE.


Article 4 – ORDER

The consumer follows the following process to place an order online:

  1. Selection of the desired product(s), automatically added to the cart.
  2. Check the cart (product, size, color, quantity, price) then validate.
  3. For the first order, enter personal information: title, first name, last name, full delivery and billing address, email, phone, password.
  4. For subsequent orders, enter only the email address and password; if the consumer uses "instant order", their information may be verified.
  5. Choose the delivery method and accept these T&Cs by checking the corresponding box.
  6. Choose the payment method, then validate the payment.
  7. Receive an automatic email confirming the order has been received.

The consumer can correct or modify their order before validation by clicking on the "Previous" button.

The final confirmation by clicking on "Validate" constitutes a firm and definitive acceptance of the order.
This "double-click" procedure constitutes consent and payment commitment, in accordance with articles 1127-1 to 1127-4 of the Civil Code and L.221-14 of the Consumer Code.


Article 5 – ORDER CONFIRMATION

LILILOTTE sends the consumer a confirmation email summarizing: seller's identity, products ordered, total price including VAT, payment methods, fees, delivery times and methods, existence of the right of withdrawal, and order number.
This email constitutes proof of the transaction and it is recommended to keep it.


Article 6 – ORDER TRACKING

Orders placed before 2 PM are processed the same day.
Orders placed after 2 PM, on Wednesday, weekends, or public holidays are processed the next business day.
The consumer can track their order and download their invoice in the "My Account" section of the website.


Article 7 – AVAILABILITY

Products are offered subject to available stock.
In case of unavailability, LILILOTTE will inform the consumer within 2 business days.
The consumer can then choose between:

  • refund within 15 days,
  • or replacement of the missing product.
    The order for the unavailable item then becomes void without compensation.

Article 8 – PRICE

Prices are indicated in euros including VAT, excluding shipping costs.
They take into account the VAT rate applicable at the time of the order.
For international orders, customs fees, local taxes, or bank conversion fees are the responsibility of the consumer.
In case of a manifest error in the displayed price, LILILOTTE reserves the right to cancel the sale.


Article 9 – PAYMENT

Payment of the price is due immediately upon ordering.
Accepted payment methods:

  • Credit card (CB, Visa, Mastercard) via a secure SSL and 3D Secure system provided by Banque Populaire, guaranteeing the confidentiality and security of banking data;
  • Bank transfer (France only) – LILILOTTE's bank details are provided during the order;
  • PayPal, for holders of an active PayPal account.

Payment in 3 installments: possible for any order over €100 with Oney, subject to acceptance by the payment provider.
By these presents, the customer accepts:

In case of failure to collect an installment, the remaining balance becomes immediately due. LILILOTTE reserves the right to refuse an order in case of dispute, payment refusal, or non-receipt of funds.
Banking data are neither transmitted nor stored by LILILOTTE.


Article 10 – RETENTION OF TITLE

The products remain the property of LILILOTTE until full payment of the price.
In case of non-payment, LILILOTTE may reclaim the products.


Article 11 – DELIVERY

Delivery corresponds to the transfer of physical possession of the products.
LILILOTTE delivers to France, Europe, and internationally.
Orders are shipped within a maximum of ten (10) business days after order validation. Delivery methods and rates:

  • Colissimo home delivery (no signature) — mainland France: €6,
  • So Colissimo pickup point — mainland France: €4.50,
  • Free delivery for orders over €190 at a pickup point.

Packages are adapted and items are carefully protected.
The average delivery times observed by Colissimo are 48 hours for mainland France and 4 to 5 days for overseas and international destinations. For deliveries outside mainland France, the order may be subject to local taxes, customs duties, or clearance fees, which are the responsibility of the consumer.
Any address error or failure to collect the package may result in recharging of shipping fees.


Article 12 – RIGHT OF WITHDRAWAL / RETURNS & REFUNDS

12-1 – Right of Withdrawal

The consumer has a period of fourteen (14) calendar days from receipt of the product(s) to exercise their right of withdrawal in accordance with Article L.221-18 of the Consumer Code.
The return request can be made via the form available in the "My Account" section, under "Order History and Details," or by email to contact@lililotte.com. Items must be unworn, unwashed, intact, and returned in their original packaging.
LILILOTTE will proceed with a full refund, including initial shipping costs, within fourteen (14) days of receipt of the returned product or proof of shipment.


12-2 – Return Procedures

Returns are made by post to the following address:
LILILOTTE – 3 rue des Fardais, 44700 Orvault (France). Upon request to contact@lililotte.com, LILILOTTE will send a prepaid return label to print and attach to the package. Two options are offered:

  • Refund as store credit – return shipping costs are free,
  • Refund to the original payment method – a fee of €6.50 will be deducted from the refunded amount, corresponding to return shipping costs.

Incomplete, damaged, or soiled items cannot be accepted.
Returns must be made within fourteen (14) days of the request.
For orders delivered from abroad, the return remains the responsibility and at the expense of the customer.


12-3 – Exceptions

The following cannot be exchanged or returned:

  • washed, worn, or damaged items,
  • or customized products (Article L.221-28 of the Consumer Code).

Direct exchanges are not possible.
For any new size or item, the consumer must place a new order after the refund.


12-4 – Defective Products or Preparation Errors

In case of defective product, delivery error, or recognized hidden defect, LILILOTTE will cover the re-delivery costs.


12-5 – Responsible Approach

In an ethical and thoughtful approach, LILILOTTE prioritizes responsible management of returns to limit unnecessary transportation and environmental impact.
This approach reflects the brand's philosophy: sustainable is adorable.


Article 13 – LIABILITY / WARRANTIES

LILILOTTE cannot be held liable in case of force majeure, internet outage, or improper use of the product.
Products benefit from the legal guarantee of conformity (Articles L.217-4 to L.217-14 of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).
The consumer can request repair, replacement, or refund of the defective product.


Article 14 – PERSONAL DATA

Collected data is necessary for processing orders and managing customer relationships.
In accordance with Regulation (EU) 2016/679 (GDPR), the consumer has the right to access, rectify, object, delete, and port their data.
These rights can be exercised:

  • or by mail to LILILOTTE – 207 boulevard Auguste Peneau, 44300 Nantes.

Data is not transmitted to third parties for commercial purposes.
The consumer can contact the CNIL (www.cnil.fr) in case of non-compliance with their rights.


Article 15 – INTELLECTUAL PROPERTY

The entire website, texts, images, logos, brands, and models are the exclusive property of LILILOTTE.
Any total or partial reproduction without written authorization is prohibited.


Article 16 – AMENDMENT OF T&Cs

LILILOTTE reserves the right to modify these general terms and conditions at any time.
The applicable T&Cs are those in force at the time of the order.
If a clause is declared null, the others remain applicable.


Article 17 – APPLICABLE LAW / MEDIATION

This contract is governed by French law.
In case of dispute, the consumer must contact customer service at contact@lililotte.com.
If no amicable solution is found within 21 days, they can use the mediator MEDICYS free of charge:

In the absence of an agreement, French courts shall have sole jurisdiction.
